Some counterfeit goods on Shein and TikTok (an alleged fact) were part of a series of warnings issued by the U.S. Chamber of Commerce (USCC) to the U.S. Trade Representative (USTR).

In the first instance, the USCC stated that various stakeholders have expressed concern about counterfeit goods allegedly offered through Shein’s e-commerce platform.

Among the cases cited are advertisements for products that imitate protected logos, items featuring images of characters, designs from luxury brands, and other branded products.

Rights holders and industry associations have also reported the reappearance of listings and sellers who had previously been sanctioned. They have also cited difficulties in securing effective corrective measures.

According to the USCC, U.S. lawmakers, trade associations, and trademark protection organizations have called for greater oversight. In this regard, they question whether the platform’s mechanisms effectively deter abuses. These measures include market monitoring and seller verification. Furthermore, they cast doubt on the procedures for reporting and removing content, as well as the policies applied to repeat offenders.

Mirror Quality

The USCC made these recommendations as part of the 2026 review of notorious markets for counterfeiting and piracy.

The Chamber argued that TikTok should also be considered for inclusion, as its social commerce platform facilitates and even encourages the promotion and sale of sophisticated counterfeit products, including so-called “superfakes” and “superclones.”

TikTok Shop’s own policies expressly prohibit counterfeits, replicas, “1:1 mirror copies,” “AAA replicas,” and “mirror-quality” products. In the USCC’s view, this prohibition demonstrates that the company recognizes the clear regulatory compliance risk posed by these practices. Despite this, the USCC noted that it is well known that the platform continues to host and give significant visibility to numerous creators who promote the sale and use of counterfeit products.

The USCC is the world’s largest business organization. It represents more than three million companies and advocates for policies aimed at economic growth.
