Mexico imposed a definitive antidumping quota of $ 13.13 per piece on imports of bottle-type hydraulic jacks originating in China, regardless of the country of origin, which enter through tariff section 8425.42.02 of the TIGIE, or any other.
Initially, on July 22, 2019, Industrias Tamer requested the initiation of the administrative investigation for unfair international trade practices, in its modality of price discrimination on this case.
Then, on November 1, 2019, the Resolution to initiate the anti-dumping investigation was published in the Official Gazette of the Federation (DOF) and the period under investigation was set to be from April 1, 2018 to March 31, 2019 and as Damage analysis period is from April 1, 2016 to March 31, 2019.
The product under investigation is hydraulic cylinder type jacks with integral pump with a load capacity of 1.5 to 20 tons. Said merchandise is commercially known as hydraulic bottle jack or bottle jack with a load capacity of 1.5 to 20 tons.
From January to October 2020, Mexican imports of these hydraulic jacks totaled 2.6 million dollars, of which those originating in the United States were for 1.4 million and those originating from China for 1.1 million, according to data from the Ministry of Economy.
According to the provisions of article 66 of the LCE, importers who, pursuant to this Resolution, must pay the final compensatory fee, will not be obliged to pay the same if they verify that the country of origin of the merchandise is different from China.
The verification of the origin of the merchandise will be carried out in accordance with the provisions of the Agreement that establishes the rules for determining the country of origin of imported merchandise and the provisions for its certification, for non-preferential purposes (previously Agreement by the establishing the rules for determining the country of origin of imported goods and the provisions for their certification, in the matter of countervailing duties).
The operating principle of bottle-type hydraulic jacks responds directly to Pascal’s principle, which establishes that the pressure applied to a fluid contained in a closed container is transmitted uniformly in all its points; Hydraulic bottle jacks are mainly composed of the following parts: base, main plunger, rod receptacle, pump, pump plunger gasket, guide cap, screw head, main plunger gasket, fill plug, main cylinder, cover gasket, control valve, extension device, lifting mechanism, shut-off valve, injector plunger, pins and actuator rod.
As an interested party in this case, the company Comercializadora México Americana participated.
