Cambian reglas para el transporte marítimo


Todas las embarcaciones estarán obligadas a declarar la Masa Bruta Verificada (MBV) de los contenedores con carga de exportación, a partir del 1 de julio del 2016.

El requisito fue establecido luego de que ocurrieron varios accidentes en puertos del mundo, entre ellos la caída de montacargas, el desplome de grúas pórtico o el hundimiento de barcos, como consecuencia de un sobrepeso en los contenedores con respecto a los registros declarados.

La regulación se establece en las enmiendas al Capítulo VI del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (Normativa SOLAS), aprobadas por el Comité de Seguridad Marítima de la Organización Marítima Internacional (IMO, por su sigla en inglés), en una resolución de noviembre de 2014.

El embarcador es el único responsable de obtener y documentar la MBV, la cual se obtendrá a través de un instrumento de medición checado por una unidad acreditada por la Entidad Mexicana de Acreditación (EMA).

La compañía naviera respectiva deberá habilitar sus sistemas para recibir la información; es decir, deberá proporcionar a sus clientes un medio, preferentemente electrónico, para que éste pueda declarar la MBV del contenedor.

La información deberá ser compartida con tiempo suficiente para ser utilizada en el plan de estiba, por lo que la compañía naviera informara sobre los cierres documentales que aplican para cada uno de sus servicios.

De no ser proporcionada la Masa Bruta Verificada, el contenedor no podrá ser cargado a buque.

Existen dos métodos para obtener la MBV autorizados: el pesaje del contenedor lleno y sellado, o la suma de los bultos o cajas que se consolidan dentro del contenedor, el         material de sujeción y tara del contenedor.

La IMO emitió las Directrices Relativas a la MBV de los contenedores con carga, las cuales representan una guía de recomendaciones para la aplicación de la enmienda.

Sin embargo, cada uno de los países deberá adaptar estas directrices a su legislación local. En México, la Dirección General de Marina Mercante emitió ya estos lineamientos para su aplicación; están disponibles en su página, y serán oficiales una vez que pasen por la Comisión Federal de Mejora Regulatoria (Cofemer).
