Cofece investigates digital advertising services

The Federal Economic Competition Commission (Cofece) reported that it initiated an ex officio investigation for the possible conduct of relative monopolistic practices in the market for digital advertising and related services.

Initiation of the ex officio investigation identified with the file number IO-003-2020, for the possible conduct of conduct that could update the relative monopolistic practices provided for in articles 10, sections III and / or XI, 11, 12 and 13 of the Federal Law on Economic Competition.

The acts that may constitute violations of any of the laws must be determined, where appropriate, in the opinion of probable responsibility.

Cofece stated that this agreement refers only to the beginning of an administrative investigation procedure in which the acts that, if applicable, may constitute a violation have not yet been definitively identified, nor is the subjects who, where appropriate, should be heard in defense as likely responsible for an infringement of the aforementioned regulations, as well as the relevant market (s).


This procedure should not be understood as a prejudging of the responsibility of any economic agent, but rather as an action by the authority to verify compliance with the law.

Corresponds to the General Directorate of Investigations of Relative Monopolistic Practices of Cofece:

  1. Initiate and coordinate investigations that, due to relative monopolistic practices, are carried out ex officio or at the request of a party, as well as collaborate with other areas in the matters in which they are requested.
  2. Issue, with the prior agreement of the Executive Secretary, the documentation and information requirements in accordance with the provisions of article 31 of the Law, as well as summon those who are related to the investigations or cases in question to testify, using, where appropriate , the enforcement measures indicated in the Law.
