Sener of Mexico creates LitioMx

Mexico‘s Ministry of Energy (Sener) issued a decree to create Lithium for Mexico (LitioMx), whose functions will be the exploration, exploitation, benefit and use of lithium in the country.

On September 30, 2021, the head of the Federal Executive, Andrés Manuel López Obrador, sent to the Chamber of Deputies the electricity reform initiative, whose proposal was to amend Articles 25, 27 and 28 of the Mexican Constitution.

This project was not approved by the Legislative Branch; however, on April 20, 2022, both chambers modified the Mining Law, reserving the power to explore and exploit lithium to the Mexican State.

Currently, from the perspective of the Mexican Chamber of Mines (Camimex), the challenge remains the same as the one it set forth in the open Parliament and is to communicate that the restriction on the use of any mineral considered as strategic is a sign of uncertainty for mining operations in Mexico, both for those already working in the country and for future developments.

This, according to Camimex, could have a negative impact on the contribution that responsible mining companies make to the economic reactivation that is so necessary for Mexico.

It also added that this puts at risk the employment of more than 3 million families that depend on this activity, with decent wages, as well as the welfare of more than 690 communities where there is no possibility to develop another economic activity.

Likewise, Camimex considers that although there is not enough information available on lithium reserves in Mexico, it is a fact that an exploration effort of the territory is required in search of deposits, long maturity periods for projects and heavy investments that could seriously affect the public budget, in order to develop and have the technology to exploit this mineral.

Also, it is imperative to be aware that the minerals are already property of the Nation, since article 27 of the Constitution establishes that it has dominion over all the natural resources of the continental platform and the submarine sockets of the islands, which includes lithium and all minerals, therefore it is not necessary to reform an issue that is already regulated.

In the decree published by the Sener, it is established that LitioMx will be a decentralized public agency of the Federal Public Administration and coordinated by the Sener itself.
