Metal lockers: EU imposes countervailing duties on China

The United States imposed countervailing duties on imports of certain metal lockers and their parts originating in China.

The Commerce Department (DOC) announced an affirmative preliminary determination in the countervailing duty investigation of these products, after concluding that Chinese exporters received countervailing subsidies at rates ranging from 36.83 to 144.01 percent.

As a result, the Commerce Department instructed Customs and Border Protection (CBP) to collect cash deposits from China’s metal locker importers based on the preliminary rates indicated above.

The petitioners are List Industries, Inc. (Deerfield Beach, FL), Penco Products, Inc. (Greeneville, NC) and Tennsco LLC (Dickson, TN).

The Commerce Department is scheduled to announce its final determination on this metal locker case on or about April 21, 2021. This period can be extended.

If DOC makes a final affirmative determination, the International Trade Commission (USITC) will be scheduled to make its final injury determination on or about June 4, 2021.

If Commerce makes a final affirmative determination in this investigation and the ITC makes a final affirmative injury determination, DOC will issue a compensatory order.

Finally, if the DOC makes a final negative determination of dumping or the USITC makes a final negative determination of injury, the investigation will be terminated and no order will be issued.

The petitioners estimated that the value of China’s metal lockers imports in 2018 was $ 64 million.
