EU modifies EU tariffs in disputes over large civil aircraft

The United States reported on December 30 that it adjusted tariffs on certain products imported from the European Union (EU).

The United States was authorized in October 2019 to impose additional tariffs on approximately $ 7.5 billion worth of EU products as a result of the WTO Large Civil Aircraft litigation.

According to the White House Trade Representation (USTR), the United States implemented its authorized countermeasures in a restricted manner and used business data from the previous calendar year to determine the number of products to cover.

In September 2020, the EU was authorized to impose tariffs affecting $ 4 billion on US trade as a result of WTO-related litigation.

However, the USTR argued; When implementing its tariffs, the EU used trade data from a period when trade volumes had been drastically reduced due to the horrific effects on the global economy of the Covid-19 virus.

“The result of this election was that Europe imposed tariffs on many more products than would have been covered if it had used a normal period. Although the United States explained to the EU the distorting effect of the selected time period, the EU refused to change its approach, ”the USTR said in a statement.

As a result, the USTR added, to keep the two shares proportionate to each other, the United States is forced to change its reference period to the same period used by the European Union.

However, in order not to aggravate the situation, the United States is adjusting product coverage by less than the total amount that would be justified using the time period chosen by the EU.

The EU made another decision that unfairly increased the amount of retaliation.

The EU calculated the amount of trade to be covered using the trade volume of the EU-27 (ie excluding UK trade).

The effect of this was an unfair increase in retaliation during the 52 days that the UK remained within the EU for tariff purposes. The EU must take some measures to redress this injustice.

Products subject to additional tariffs include aircraft manufacturing parts from France and Germany, certain non-sparkling wines from France and Germany, and certain cognac and other grape brandies from France and Germany.
